1.Orders
1.1 Your order of a vehicle from Thememberscarclub is an offer by you. The company will only accept an order from you when you have signed and returned a purchase order in accordance with these terms and conditions. All orders are subject to the acceptance of the company which is dependant upon the availability of the vehicle being ordered, price changes.
1.2 If you wish to purchase the vehicle you should read and sign the purchase order form and return to Thememberscarclub by signing and returning the purchase order form you agree to purchase a vehicle of the specification detailed in accordance with these terms and conditions.

2.Prices
2.1 The prices quoted includes VAT, delivery to the dealer, number plates, 12 months road fund licence and first registration fee.
2.2 Thememberscarclub reserves the right to change the price either before or after Thememberscarclub accepts any order. Thememberscarclub shall notify you of such a change and you have the right to cancel your order if the change is not acceptable.
2.3 Prices on the quotation form are for information purposes only and do not constitute an offer by us capable of an acceptance by you.
2.4 In the event that any of our vehicles are listed at an incorrect price or are no longer available. Thememberscarclub shall have the right to refuse to accept any order from you or to cancel any order received from you based on the incorrect price, whether or not the order has been accepted.
2.5 All cars registered on the 4th January 2011 or after will include VAT at the new rate of 20%.The VAT rate is charged at the point of invoice not ordering.

3.Deposit
The benefit of being a member is that we do not require a deposit to order your new Car or Van

4.Payment
4.1 Payment shall be made by cheques or by bank transfer.
4.2 Payment of the balance due on the vehicle must be made in the manner as agreed with Thememberscarclub Title will only transfer to you when cleared funds have been received.
4.3 Permission must be given if we are to accept final payment from a third parties.For example finance/ leasing companies.

5.Delivery/Registration
5.1 Thememberscarclub shall arrange with you delivery of the vehicle to your home or office. Thememberscarclub will arrange delivery, the transport company will undertake the actual delivery itself. On delivery of the vehicle you will be required to sign an inspection sheet confirming that you have inspected the vehicle and that it complies with the specification detailed in the purchase order form and that the vehicle is undamaged. If any of the foregoing is incorrect, you will inform Thememberscarclub immediately by quoting on the inspection sheet in which case the following will apply
If the vehicle is damaged you will have the option to
a. Reject the vehicle and receive a full refund.
b. Have the vehicle repaired free of charge in which case we will inform you of an alternative date for delivery.
c. Accept the vehicle and arrange your own repairs at the Companys cost. If this is your preferred option you must obtain three quotations for the repairs and the Company will select its preferred repairer; or you may request the Company to re-order a new vehicle.
If the vehicle does not meet the specification detailed in the purchase order form the Company will refund the monies in full or re-order the correct vehicle and arrange an alternative date for delivery.
5.2 Deliveries are restricted to mainland Britain, however a further charge will apply for deliveries to Scotland.You will be informed in advance of this amount.
5.3 The vehicles supplied by Thememberscarclub are either brand new or pre-registered we will confirm the registration status before we except your order.
5.4 The company will make every effort to deliver the vehicle on the delivery date specified in the purchase order. However, delays will occasionally occur and time shall not be the essence of this contract.The company shall not be liable for any damage or loss including consequential loss occasioned to you or any third party arising directly or indirectly out of any failure on the company's behalf to meet the estimated delivery time.

6.Cancellation of Orders
6.1 If you cancel your order outside of the clause 6.4 you acknowledge Thememberscarclub will claim the cost of unrecoverable extras fitted to the vehicle, and any reduction in the value of the vehicle will be entitled to use the deposit and any prepayment to reduce its reasonable losses.
6.2 You shall only have the right to cancel your order if there is a delay in delivery exceeding 14 weeks from the date specified in the purchase order form.If you wish to cancel your order under the provisions of this clause you must notify the company in writing. If we do not receive such written notification the company shall be entitled to regard this as a waiver of your right of cancellation.
6.3 In the event that the Company can source an alternative purchaser for the vehicle our reasonable administration and storage charges will be limited to a maximum of £3,000.00
6.4 Under the Distance Selling Regulations 2000 you have a right to cancel your use of our services without charge, therefore the above sub clauses will not apply.This cancellation right ends on the expiry of the 7th day on receiving the goods.You will be required to arrange transport delivery at a cost to yourselves to our depot in Derby and take reasonable care of the vehicle prior to this.When the vehicle is received, you must provide us with all keys, registration documentation, optional extras, equipment accessories and all other documentation and paperwork supplied with the Vehicle.If the car has suffered any damage which was not caused by us, you accept there will be an appropriate reduction in the amount of money to be returned to you or if the car has been made to your specifications or clearly personalised.Please note a further reduction will apply if the vehicle has exceeded 100 miles or move than what is recorded on the handover checklist.
6.5 Please note we do not sell vehicles to UK Dealerships or personal working for them.We have the right to cancel any orders we have taken that fall in to this clause at any time.

7 Statutory Rights
7.1 Your statutory rights including any rights you have as a consumer are not affected by anything in these terms and conditions.Third party rights under the Contracts (Rights against Third Parties) Act 1999 are hereby excluded.

8 Waiver
Complaints Handling
Thememberscarclub is committed to customer service. Should you have any complaint about the Thememberscarclub , Thememberscarclub is committed to resolving complaints in a fair and effective manner.
Please inform Thememberscarclub by email sales@thememberscarclub.com should you have any complaint about our service.We are committed to acknowledging your complaint within 48 hours of receipt and undertaking all reasonable efforts to resolving it promptly under the circumstances.We will provide you with a time scale for resolving the dispute and keep you regularly updated with respect to our progress.
